Former employer unpaid holidays, sick leave and more. Advice appreciated!
I am in need of some legal advice regarding a BOI registered company I have worked for before. I need advice regarding what the law says about unused holidays (21 days as per contract per calendar year), working on national holidays without 200% compensation, 30 days paid sick leave per year (if sick we didn't get anything at all) as well as working from home without any compensation except provision. As far as I have understood it is mandated in Thai law that the employee is supposed to get 200% of the salary when working on national holidays or for overtime. They are entitled to 30 days of paid sick leave per year. This company has already been audited before and some people working without a visa got banned permanently from Thailand.
Former colleagues of mine have already been compensated but been asked to sign a non-disclosure. However the company refuses to process my claim.
What would be the best way to proceed? A lawyer or going to the Labour department?
